Terms and booking conditions:

All Safaris / Tours are operated by Barefoot Safaris and Adventure Tours (hereinafter called 'the Company' or 'we'), and are sold subject to the following conditions:

  1. Booking
    To make a booking you must be over 18, must provide written confirmation via Email and provide the agreed deposit in full (or full payment if travel is within 60 days). Deposits are non-returnable. The person making the booking (the “lead name”) accepts these booking conditions on behalf of everyone in their party. If we accept your booking, we will issue a confirmation invoice or letter detailing the cost of the agreed tour.

    A contract will exist between us from the date we issue the confirmation invoice or letter. If you had not seen these booking conditions when you made your booking (and you will be taken to have seen and accepted them if you have sent us a confirmation Email / Letter - indicating that you have done so) and you are not happy to proceed with the booking now that you have seen them, please return all documentation to us. Your booking will be cancelled and your monies will be returned in full. This ‘cooling off’ period does not apply if booking within 60 Days.

    If you book within 60 days of departure you must pay for your Safari in full and you must provide a letter of confirmation via Email. On some tours a local payment is payable in addition to the basic tour price. Your personal safety is of paramount importance to us and therefore it is imperative that you advise us at the time of booking of any condition, medical or otherwise, that might affect your or other people’s enjoyment of the trip.

  2. Payment
    When you receive our letter confirming the cost of your tour, please check the details carefully and inform us immediately if anything is incorrect. Spelling of names etc. is particularly important. Names on travel documents must exactly match those shown in passports; we cannot accept responsibility if an airline or other supplier refuses boarding because the name(s) shown in your passport differ from those on your ticket.

    Payment for all monies due, including any surcharge, must be paid to us no later than 60 days before tour departure. If you do not pay the balance by the due date your booking will be cancelled and you will forfeit your deposit.

  3. If you change your booking

    If, after our confirmation has been issued, you:

    1. make a change to your existing booking, we will charge an amendment fee of a minimum of US$ 70 per booking for each change or
    2. wish to change to another of our tours or change departure date, we will try to make the changes, provided that notification is received in writing at our offices from the lead name at least 60 days before departure and you pay a minimum of US$ 50 per person to cover our administration costs.

    Any alteration, whether a change to an existing booking or a change to another tour or departure date, will be subject to payment by you of any costs imposed by any of our suppliers providing the component parts of the tour. Any alteration by you within 60 days of departure will be treated as a cancellation of the original booking and will be subject to the cancellation charges set out in Section A (How to Book).

    NB: Once a tour is in progress, it is not possible to amend or deviate from the agreed itinerary (unless unforeseen circumstances dictate otherwise) without written authority from the Director. Tour Guides do not have the authority to make changes to the agreed itinerary or accommodation. Any changes requested once the tour is in progress agreed with the Director will be subject to a surcharge of US$ 800 per person and must be paid in cash before any changes will be implemented.

  4. Complaint Procedure
    If you have any complaint during your holiday, you must inform both your Safari guide and the relevant supplier of the service immediately. If you are not happy with their action in response to your complaint, you should notify our office in Lilongwe immediately, and we shall endeavour to resolve the problem promptly. Failure on your part to notify us and our agents does not give us the opportunity to take appropriate action to put things right, and may seriously affect your legal rights. If you feel the problem has still not been dealt with, you should notify us in writing within 30 days of your scheduled return, giving us your booking reference and all other relevant information. We will acknowledge your written notification within 7 days and aim to provide a full response within 28 days. It is unlikely that you will have a complaint that cannot be settled amicably between us.

  5. Claims against third parties
    If you, or any member of your party, suffer death, illness or injury whilst overseas arising out of an activity which does not form part of your package travel arrangements, we shall at our discretion, offer advice, guidance and assistance to help you in resolving any claim you may have against a third party, provided we are advised of the incident within 30 days of its occurrence.

  6. Surcharges
    Prices quoted for this programme are based on the exchange rates published by Reuters on the day of booking. The price of your tour may be subject to surcharges on the following items:

    1. transportation costs, including the costs of fuel,
    2. dues, taxes or fees chargeable for services such as landing taxes or embarkation or disembarkation fees at ports and airports or
    3. the exchange rates applied to the particular package. In the case of any small variation, an amount equivalent to 2% of the price of your travel arrangements, which excludes insurance premiums and any amendment charges, will be absorbed or retained. For larger variations than this 2% will still be absorbed for increases but not retained from refunds. In either case there will be an administration charge of US$ 50 per person together with an amount to cover agents’ commission. If this means that you have to pay an increase of more than 10% of the price of your travel arrangements, you may cancel your travel arrangements and receive a full refund of all monies paid, except for any amendment charges. We will consider an appropriate refund of insurance premiums paid if you can show that you are unable to transfer or reuse your policy. Should you decide to cancel because of this, you must exercise your right to do so within 14 days from the date of issue printed on the invoice. No surcharge will be imposed within 30 days of your departure. Whether you cancel or not you will also be entitled, in the terms set out in respect of major changes in clause 9, to accept an offer of alternative travel arrangements from us if we are able to do so and compensation set out below. Travel arrangements are not always purchased in local currency and some apparent changes have no impact on the price of your travel due to contractual and other protection in place. We have included in our prices a charge representing the extra aircraft insurance and security costs which have been imposed on airlines and tour operators. You should be aware that this charge may change between the date of publication and the time of travel.

    Since these costs are beyond our control, we reserve the right to increase the amount of this charge at any time. We will of course inform you of any such change should that become necessary. In view of the current volatility of world oil prices, a fuel supplement may be added to the price of your holiday at the time of booking. The ‘Local Payment’ on some trips can fluctuate occasionally - if this increases significantly we will advise you in advance.

  7. Changes to your trip
    Before you enter into a contract with us, we reserve the right to change any of the facilities, services or prices described in our trip dossiers or website. If a change occurs you will be advised at the time of booking.

  8. Independent arrangements/excursions
    If you purchase any optional activities that are not part of your pre-booked itinerary, the contract for the provision of that activity will be between you and the activity provider. The decision to partake in any such activity is entirely at your own discretion and at your own risk. If you do have any complaint about or problem with, any optional activity purchased in resort your claim should be directed to the activity provider and not to Barefoot Safaris

  9. Transport timings
    Please note that the timings of air, sea, road or rail departures are estimates only. These timings may be affected by operational difficulties, weather conditions or failure of passengers to check in on time. Carriers’ conditions of carriage which will apply to you, have clauses which limit or exclude liability. We do not make any arrangements if there is a delay at the outbound or inbound point of departure. However, most airlines usually make provision in this case.

  10. Travel Insurance
    Travel insurance is mandatory for all clients while on one of our Safaris. You must make your own insurance arrangements you must ensure that there are no exclusion clauses which limit cover for the type of activities included in your tour.

  11. Passports and visas
    Whilst we are able to provide basic advice to clients regarding passports and visa requirements, you should check with the appropriate Embassy, Consulate or British Foreign Office for the exact requirements for your chosen Safari and date of travel. It is your responsibility to ensure that you have the correct passport and visas to gain access to any country/region included in the travel arrangements which you purchase from us. If you fail to do so, we have no liability to you for any cost, loss or damage which you suffer, nor will we refund you the cost of any unused portion of your travel arrangements. In some cases, countries will refuse entry to clients who have criminal records. Should you be concerned about this, please check with the embassy or consulate of the countries to which you are travelling.

  12. Health requirements
    We are able to advise on mandatory health requirements; however, we are not medical experts. It is your responsibility to ensure that you obtain proper and detailed medical advice. Where you do not do so and either are not allowed to enter any country, or suffer personal injury or death, we have no liability to you for any cost, loss or damage which you suffer nor will we refund you the cost of any unused portion of your travel arrangements. Clients with existing medical problems, pregnant women and anyone who has recently visited other countries, should check requirements with their general practitioner.

  13. Special requests
    We endeavour to fulfil any special requests (e.g. vegetarian meals) and will pass your request to our suppliers but do not guarantee that the request will be carried out.

  14. Your contractual requirements
    Once a contract exists between us you agree to accept the authority and decisions of our employees, Safari guides, agents and suppliers while on tour. If, in the opinion of any of these, your health or conduct appears likely to endanger the progress of a tour you may be excluded from the whole of, or a part of, the tour. In the case of ill-health we may make such arrangements as we deem necessary and recover the costs thereof from you. If you commit an illegal act we shall cease to have responsibility to or for you.

  15. Alterations to booking conditions
    No employee or agent of Barefoot Safaris shall vary these conditions or offer any refund or discount on the published price without the written consent of a director of Barefoot Safaris.

  16. Notices
    All communications relating to this Agreement (in particular any requests to cancel or amend your holiday arrangements) must be from the Lead Name in writing and in English and delivered by hand or sent by recorded delivery post to the address specified herein (or such other address as may be notified to you from time to time). Any such communication shall take effect when a complete and legible copy of the communication has been received at the appropriate address: ken@barefoot-safaris.co.za

  17. Dates, itineraries & pricing
    Dates, itineraries and prices for Safaris may be subject to change at any time. Current dates and prices are listed on our website and will be provided at the time of enquiry.

  18. Contractual obligations
    These conditions were published on 15th August 2015 and apply to all Safaris / Tours operated and run by Barefoot Safaris and Adventure Tours.

  19. Website Photography
    Any likeness or image of you secured or taken on any of our holidays may be used by the company without charge in all media (whether now existing or in the future invented) for bonafide promotional or marketing purposes, including without limitation promotional materials of any kind, such as brochures, slides, video shows and the internet.

  20. Acceptance of Risk
    Barefoot Safari’s mission is to take our customers further from the tourist trail than our competition. Barefoot Safari’s trips are likely to offer circumstances which may involve risk to the customer. By booking a tour with Barefoot Safari’s, the customer acknowledges and accepts any and all risk associated with travel. The customer is strongly encouraged to contact their Embassy and detail their travel plans. The customer must purchase travel insurance and will not hold Barefoot Safari’s liable for damages, injury or death. Barefoot Safari’s may require customers to sign a participation and waiver form as follows:

    “I understand that travel with Barefoot Safari’s entails risk to my belongings and my person. I understand that this trip will take me to places where standards of hygiene and health care are unlike those I am used to at home. I understand that the destination presents certain perils to my safety and wellbeing. I understand that I may be some considerable distance from health care facilities. I accept these risks and waive my right to hold Barefoot Safari’s liable for any damages, injury or death.”

  21. FACTORS OUTSIDE Barefoot Safaris CONTROL (FORCE MAJEURE)
    Barefoot Safaris endeavours to conduct its operations safely and to complete all activities and excursions as set out in our trip dossiers. The company is aware of the risks of flooding, landslides and other natural disasters, especially during the annual rainy season; the company makes efforts to inform customers of any risky political situation which may arise in any destination or country, we visit. However, Barefoot Safaris is not liable in the event we are not able to conduct any activity or excursion or game drive, as per the trip dossier or any other document, or injury, death, financial loss or any other damages incurred as a result of Force Majeure; e.g. political turmoil, riots, war, landslides, flooding, un-passable roads etc. Barefoot Safaris requires customers to carry insurance that covers such unforeseeable circumstances. If our customers do not have same any cost will be for their own account. Also refer to The BAREFOOT Challenge

  22. The BAREFOOT Challenge
    Before booking with us, take a moment to consider the challenging nature of adventure travel. Trips of this kind often require a substantial amount of flexibility from you during the journey. The itineraries outlined in our trip dossiers and on our website must be seen as an indication of our intention, rather than a contractual obligation on our part. Unforeseen local conditions or events may sometimes necessitate changes to the itinerary, accommodation or means of transport. We accept your booking on the understanding that you realise the potential hazards involved in this kind of trip, including injury, disease or loss/damage to personal property, inconvenience and discomfort. Refunds will not be given for unused services.

How to book:
Having confirmed availability, a non-refundable deposit of 20% of the tour fare is needed to secure your participation / reservation. Once we have [or receive proof of] this payment together with your completed booking form, your booking is confirmed and accepted by us. Final and full payment must be made prior to the safari/ occupation. In the case of Bank transfers - Please allow 14 days prior to departure. Cash & travellers cheques are accepted on the day of departure / participation. If paying in Malawi Kwacha please note we use the HIGHER BUYING rate of commercial money bureaus. Payments by credit card carry a 6% bank charge – should your credit card be rejected it is your responsibility to call the credit card company or settle your bill by other means.

  1. Cancellations:
    Refunds as follows:
    As far as possible, you will be offered an alternative date without penalty – should this not be possible, we charge applicable cancellation fees:
    Until 31 days prior to departure: 20 % Cost of services due
    30 - 21 days prior to departure: 25% Cost of services due
    20 - 07 days prior to departure: 40 % Cost of services due
    06 - 0 days prior to departure: 100% payment due

  2. Insurance:
    Travel insurance covering cancellation, curtailment and all medical expenses with air evacuation is compulsory for all clients traveling with BAREFOOT SAFARIS. The reservation office may ask to see proof of your insurance policy.

  3. Passports, and departure taxes:
    It is the sole responsibility of the guest to ensure that his / her passport and relevant travel documents are in order.

    VISAS – This is the responsibility of the client - BAREFOOT cannot accept responsibility for costs, delays or non-participation due to immigration problems. Any resultant costs will be yours to bear.
  4. Health:
    Anti-malaria precautions must be taken, and these are the sole responsibility of the guest. Consult your doctor or pharmacist.

    YELLOW FEVER CERTIFICATES ARE REQUIRED TO ENTER ZAMBIA – BAREFOOT SAFARIS cannot assist with this.

  5. Responsibility:
    Neither BAREFOOT SAFARIS (herein called the company) nor any person acting for, through or on behalf of the company shall be liable for any loss or damage whatsoever and without restricting the generality of the foregoing shall particularly not be responsible for loss or damage arising from any errors or omissions contained in its brochure or any other literature, late or non-confirmation or acceptance of bookings, loss or damage caused by delays, sickness, injury or death, whether occasioned by negligence or not.

    In addition the company shall have the right at any time at its discretion to cancel any tour or the remainder thereof or make any alteration in route or time should any cause in the opinion of the company make it necessary to do so, and shall not be liable for any loss or damage whatsoever arising from such cancellation or alteration.

    The person making any booking will, by the making of such booking, warrant that he or she has authority to enter into a contract on behalf of the other person/s included in such a booking and in the event of the failure of any or all of the other persons so included to make payment, the person making the booking shall by his / her signing of the booking form assume personal liability for the total price of all bookings made by him / her.
